After having gone through the entire process last year in many heated debates with Mr. Bachul...I will not be doing it again, however with a lot of ludicrously paid players bought out last season, I will say that I'm willing to bet that the average salary in this league has gone down from last season.
Most teams do not have salary restraints, and this requires you to be an adept and active general manager. Being 'active' does not always mean being online 24/7 and through trading. It also means being responsible in your managerial ability and adhering to the league rules. I managed to stay under the cap when I had a rather major injury to Martin Havlat to start of the season (and this was being already within half a million of the cap). My team currently is the closest to the cap, and I see no problem with maintaining the level that is required by the league. There are many teams that are under the cap, and while some players are extremely undervalued in this league, that is the nature of the league, and what I find to be exciting and interesting.
You went almost 5 million over the cap...why make a deal that completely kills the team? Or better yet, why make a trade that kills the team (nothing being against the rules that was done to you), and then complain on the message board when you go 5 million over, and break the rules? That makes no sense to me.
(just for the record since I did it anyway, the average pro salary in the league is 34.32 million and the average farm salary is 553,700. Means that the cap salary is 34.8737 million...there are at least 10 teams that can afford the salary of Jaromir Jagr, and with creative management I'm sure that there are a few more...I don't think there are that many teams that are struggling with the cap as it is, and those teams that are close, I've not heard once complain about it).
Not to be rude, but I think the problem is mismanagement, and it's not a fault of anyone else but your own...so I don't think it would be accurate to go and complain about the rules, after your own mistake.

If Jagr puts you over the cap and you don't FEEL like abiding by the rules, then you get what you deserve.
