Damn it. I hate doing this job.
According to the sim Pittsburgh has played their last two games over the cap. The first instance against Florida in a 10-3 loss had Dieter Kochan start with Garnet backing up. Not sure why Gerber was not playing but those were Steve's lines last sent on the 28th and uploaded prior to simming that day. Gerber was never injured so I am unsure as to why Steve would call up Kochan.
Tentatively and likely permanently Paul Kariya has been suspended.
GENTLEMEN, GET AWAY FROM THAT CAP of $42M! If you cannot afford a simple farm call up you are playing TOO close to the cap!
I had Eric witness Pittsburgh's roster prior to me updating tonight to verify the cap violation prior to tonight's games already in place.

Ok, so it sounds like I'm losing Kariya for sure after talking to Ken. What I'd at least like here is to start a discussion, because I feel that in my case, the situation is not as clear cut as salary cap violations typically are, and I'd like to get everyone's thoughts.
Here is the full story:
I notified the league that I'd have limited internet acess until October 1. Since Sept 23 I've had for the most part only internet acess from 9:30pm onwards, and even at this point, I've been exhausted at the time. When on the net at night I've been preparing for my presentation at the conference, booking a banquet for a soccer team, organizing a soccer team for an indoor league, trying to organize to go out on a date Sat night (only hours after I'll be getting back to kingston, and yes, I do have a social life), simming for another league, and other little things. I have tried to keep up with my BRHL team as well during this time. I've been trying to squeeze this all in before 10:30 so as to get enough sleep to get up the next day at 7am for another 14 hours at the conference.
In this time I did submit a suspension appeal and submitted lines. As I wa rushed and tired at the time (the suspension appeal was like 1 sentence) I totally forgot to check my finances when I sent in my lines. We all know the outcome.
I violated the cap because I rested Gerber by benching him and calling up Kochan. The reason I called up Kochan and didn't dress Gerber as a backup is because Garnett sucks and was gonna get pulled (which he did). That's no rest for Gerber. I didn't realize I was so close to the cap because earlier in the week (when i was starting the conference) Desjardins got hurt and was replaced by McCarthy who makes like 2 million. I hadn't had time to put Desjardins on the IR yet....
NOW, given that I knew I was going to be busy this week, I could have just said I would be completely unavailable and left my team to fend for itself. Gerber would have got exhausted in net and I would have had randoms to fill in for injuries and suspensions. I would have gone over the cap anyway.
INSTEAD, I tried to keep up with my team, made a slipup, and went over the cap.
Either way I would have gone over the cap.
So I am now being punished for TRYING to stay on top of things, because if I had stayed away and gone over the cap while "away" I would not have been punished.
Hopefully I didn't miss anything.
Please lets hear some discussion. I am not going to argue further as I think I've covered the whole scenario here. I'd like to hear what everyone things either for or against me.

The verdict is in and Kariya will be suspended for the remainder of the season and become a UFA.
I formed a discussion panel with fellow GMs: Clint, Ron, Eric, Cal, and Norm in order to decide the fate of Kariya. Steve was included in the discussion as well. In a vote of 4:2 the decision was made to follow through with the suspension. I do not feel it necessary to reveal who vote which way except that the decision process was transparent to Steve.
The majority felt that although Steve posted he was away for a set time period he was still fairly active. He made a suspension appeal request during the Desjardins incident, sent in lines (which put him over), and has been available on ICQ. Steve intentionally called up his 3rd string goalie (Kochan) to back up Garnett during the games in question. Steve's intent was to fully rest Gerber. Steve did not realize his cap situation prior to the call up (McCarthy to replace Desjardins was costly) and hadn't made a motion to place Desjardins on the IR.
Normally if an injury of Desjardins surfaces while a GM is "away" and I need to call up a player that would put the team over the cap I would, as commish, take the liberty of placing the IR. However Pittsburgh was not violating the cap at the time and therefore there was no need for me to do so. When Steve sent in lines I have no choice but to load those lines and assume the GM is active. The lines submission with the questionable scratching of Gerber is what put the team in cap troubles and not the injury to Desjardins. This basically came down to GM error. With that in mind I cannot excuse GM error when administering a cap violation, if that were the case than the cap violations from last year occured largely in error.
With that, Kariya is suspended for the season.
If there are those who feel the current system of cap punishment is too severe I would welcome them to step up and we can again address the issue like last year.

I accept the punishment.
To say I am disheartened, and frustrated about this would be an understatement.
The rule is to deter people from riding to close to the cap, and to ensure that every team fields a healthy roster that does not exceed the cap. I am guilty of neither. I kept like 2 million from the cap to be sure that in the case of injuries and call-ups I wouldn't have to worry about going over. The only reason I went over was because the sim called up a really expensive player and in my haste (while away at a conference) I left him on my roster while making other roster moves that ended up putting me over the cap. If you were to consider the salaries of my healthy players I was still below the cap. The players who skated in those games in question were paid a total of less than 42 million dollars. The problem?? I didn't get a chance to ask for desjardins to have two letters "IR" placed beside his name.

If Bryce comes back on Wednesday - he's away at some emergency according to his wife who ICQed myself and Eric - and deems I went about this issue incorrectly and made the wrong judgements and wants to use his supreme power of commish to overrule than so be it. But I think Bryce would have agreed to enforce the rule and likely would not have even put it up for debate.
